SYNOLOGY STORE TERMS AND CONDITIONS (EU)
THIS DOCUMENT CONTAINS VERY IMPORTANT INFORMATION REGARDING YOUR RIGHTS AND OBLIGATIONS, AS WELL AS, LIMITATIONS, AND EXCLUSIONS THAT MIGHT APPLY TO YOU. PLEASE READ IT CAREFULLY.
BY PLACING AN ORDER FOR PRODUCTS OR SERVICES FROM THE SYNOLOGY WEBSITES, YOU ACCEPT AND ARE BOUND BY THESE TERMS AND CONDITIONS.
YOU MAY NOT ORDER OR OBTAIN PRODUCTS OR SERVICES FROM THE SYNOLOGY WEBSITES, IF YOU (A) DO NOT AGREE TO THESE TERMS, (B) ARE NOT THE OLDER OF (i) AT LEAST 18 YEARS OF AGE OR (ii) LEGAL AGE TO FORM A BINDING CONTRACT WITH SYNOLOGY, OR (C) ARE PROHIBITED FROM ACCESSING OR USING THE SYNOLOGY WEBSITES OR ANY OF SYNOLOGY WEBSITES' CONTENTS, PRODUCTS OR SERVICES BY APPLICABLE LAW.
These terms and conditions (these "Terms") apply to the purchase and sale of products through Synology Store (the "Site"). These Terms are subject to change by Synology (referred to as "us", "we", or "our" as the context may require) without prior written notice at any time, in our sole discretion. The latest version of these Terms will be posted on this Site, and you should review these Terms before purchasing any products that are available through this Site. Your purchase of products through this Site after a posted change will constitute your acceptance of the changed Terms.
1. Order Acceptance and Cancellation By Synology
1.1 Your order is an offer to purchase all products listed in your order under these Terms. All orders must be confirmed by us. We may choose to refuse any order at our sole discretion. Once the checkout is complete, we will provide you with an order confirmation email. Your receipt of an order confirmation, however, does not signify our acceptance of your order. Your order is accepted when we ship out or deliver your product. You can check the shipping status and the delivery tracking number in your Synology Account.
1.2 If your order is cancelled for some reason, we will refund the billed amount, which will not include any fees or additional charges that the card issuer or bank charges you for processing your credit card/debit card payments based on your order.
1.3 After you submit your order, we will not accept any request to modify the order or change the delivery information. If you need to modify the order, please cancel the order and then place a new order.
1.4 Synology sells and ships products acquired via Synology Store exclusively to end-users. Synology reserves the right to deny or void any product return if there is suspicion of purchase for the purpose of resale.
2. Pricing
2.1 Prices shown on Synology Store are in Euros (EUR) and include value-added tax (VAT) at a rate applicable in the jurisdiction of the customer.
2.2 In accordance with all applicable laws, statutes, regulations from time to time in force, your purchases from the Site will be taxed using the applicable sales tax rate for your shipping address. The charge listed during checkout is the final amount including all applicable taxes and customs clearance fees if any.
2.3 All promotions are considered mutually exclusive and may not be combined with any other promotional codes or concurrent bundle offers. This includes but is not limited to, special prices, bundle combinations, or other cart rule promotions unless explicitly stated otherwise in special instructions. Additionally, all promotions will not be reinstated once used, even in the case of successfully returned and refunded original orders.
2.4 Prices shown on the Site do not include shipping costs. The actual cost for shipping is calculated and displayed during checkout based on your shipping address and chosen shipping method.
2.5 We are not responsible for pricing, typographical, or other errors in any offer, and we reserve the right to change prices shown on the Site at any time and to correct pricing errors that may inadvertently occur. In the event that the price displayed on the product page or in relevant information is incorrect:
If the price displayed is higher than the correct price, we will charge you the lower price, which is the correct price.
If the price displayed is lower than the correct price, we reserve the right to refuse an order.
3. Payment
3.1 Synology Store accepts payments via Visa, MasterCard, American Express credit/debit cards, and Apple Pay. If you are paying with a credit card, the actual payment amount may fluctuate with exchange rates. In addition, your card issuer may charge you foreign transaction fees, which may increase the actual payment amount. Please contact your bank or card issuer regarding these fees.
3.2 By paying for your order with a credit card/debit card, you represent and warrant that (i) the credit/debit card information you supply to us is true, correct and complete, (ii) you are the cardholder and are authorised to use the card for the purchase, and (iii) charges incurred by you will be honored by your credit card company.
3.3 In case your payment fails due to any reason, we reserve the ownership of the purchased products until the purchase price is paid in full.
4. Privacy Policy
4.1 A Synology Account is required to sign in to the Site. The system will use your personal information in your Synology Account for processing a purchase.
4.2 In order to complete the transaction and provide subsequent services, we will provide the personal information (including, but not limited to, the address, credit card number, etc.) you have supplied to partners relating to the transaction, such as carriers, payment service providers and banks.
4.3 Please refer to the Synology Privacy Statement. Additionally, by using the Site, you acknowledge and agree that Internet transmissions are never completely private or secure. You understand that any data or information you send to the Site may be read or intercepted by others, even if there is a special notice that a particular transmission (for example, credit card information) is encrypted.
5. Shipping
5.1 Orders are shipped from Monday to Friday, excluding weekends and public holidays observed in Germany.
5.2 The delivery date provided on the Site or anywhere else is an estimate only. We are not liable for any delay, loss, damage, costs, or expenses for failure to deliver in accordance with the estimated delivery or shipment dates. We will not liable or responsible to you for any failure or delay in fulfilling or performing these Terms, when and to the extent such failure or delay is caused by or results from acts beyond our reasonable control, including, without limitation, the following force majeure events (“Force Majeure Event(s)”): (a) flood, fire, earthquake, or explosion; (b) war, invasion, hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest; (c) government order, law, or actions; (d) national or regional emergency; (e) strikes, labor stoppages or slowdowns, or other industrial disturbances; (f) telecommunication breakdowns, power outages or shortages, lack of warehouse or storage space, inadequate transportation services, or inability or delay in obtaining supplies of adequate or suitable materials; and (g) other events beyond the reasonable control of us. We will contact you as soon as reasonably possible and take reasonable steps to mitigate the delay or failure. During the period of delay or failure caused by the Force Majeure Event, our obligations will be suspended, and the time for performance will be extended accordingly. Where the Force Majeure event affects our delivery of products to you, we will arrange a new delivery date with you after the Force Majeure event is over. If the delay is likely to be substantial, you can contact our customer service to cancel the order and receive a refund, including the delivery charges, for any products you have paid for in advance, but not including the received and less reasonable costs we have already incurred.
5.3 For physical products, we will ship orders within one (1) to two (2) business days after order confirmation, but the timeframe may be longer due to holidays or other circumstances.
5.4 For non-physical products (such as licenses keys), they will be delivered to the email address you provided during the order process. The non-physical products will only be sent once and will not be reissued. Synology will not send a replacement for lost of license keys.
5.5 Supported shipping areas: (a) products purchased from the Site will only be shipped to physical addresses (excluding P.O. box addresses) within the European Union except for Malta, Switzerland, Monaco, Andorra, and Liechtenstein; (b) orders with shipping addresses in Switzerland, Cyprus, Greece, Ireland, Portugal, Andorra, and Liechtenstein will not be eligible for free shipping.
5.6 You can track the shipping status of an order in your Synology Account, and check the actual logistics status with the tracking number provided by the carrier. If you experience any problems with the delivery, please contact our customer service.
5.7 We reserve the right to cancel your order for a product and claim any compensation under the circumstances that (a) you fail to provide the necessary information we need within a reasonable time for us to deliver the product; (b) you do not, within a reasonable time, allow us to deliver the product to you. Extra shipping cost may be charged to you in case of incorrect recipient's address or no recipient based on the local logistic service regulations.
6. Cancellation of Order by Customer
6.1 You can cancel your order through your Synology Account before the product is shipped. After the order is cancelled, Synology will refund the billed amount, which will not include any service charges or additional fees that the card issuer or bank charges you for processing your credit card/debit card payments based on your order. The amount will be refunded within fourteen (14) calendar days. Please contact your bank or credit/debit card issuer for confirming the actual time of receipt. The way your refund is processed depends on your original payment method.
6.2 Cancellation applies to an entire order only and does not apply to a single product in the order.
7. Application for Return
7.1 Unless otherwise specified in this section, all products purchased from the Site can be returned within thirty (30) calendar days from the date of purchase (subject to the invoice date). You can request a return through your Synology Account.
7.2 If the product you received is defective, damaged, or missing accessories, and you intend to request a product exchange or re-issuance of accessories, please contact our customer service.
7.3 Once the product has been shipped, you may request a return. After you have received the product, you can either send the product back, or refuse the package upon delivery. We will arrange for a refund upon receipt of the returned product. We will refund all costs paid by you associated with the product, except for any express delivery costs (when you have not selected standard delivery) and handling fees. If your order includes both physical and non-physical products, you may request a return once the physical products have been shipped. We reserve the right to withhold the reimbursement either until we have received the returned products or until you provide the evidence that the products have been sent back to us.
7.4 After you have applied for a return, please follow the instructions to package the product and return the product to us within fourteen (14) calendar days. You are responsible for the return shipping cost, insurance, and risk of loss and/or damage with respect to returned items until they are properly received by us. We will issue a refund based on the product quantity and items received.
7.5 The product must be returned in the same condition as received, with all original packaging, accessories, documentations, and any gifts received with the product. The return must be sent to the address designated by us, with freight pre-paid and in packaging that sufficient to protect the contents. If the returned product is incomplete or shows signs of use or damage beyond what is necessary to inspect it, we may reduce your refund to account for any loss in its value, which may result from, including but not limited to, removed price tags, damaged packaging, or missing accessories. In some extreme cases, no refund may be due. Our customer service can advise you on whether we are likely to reduce your refund amount.
7.6 If the sealed software is unsealed, you will not be entitled to the return rights provided in this section. If we receive a returned product and the sealed software has been unsealed,we will return the product to you and no refund will be issued.
7.7 If the non-physical product, (including but not limited to license packs and services) is activated, you will not be entitled to the return rights provided in this section.
7.8 After a successful return of your product to us, the amount of the returned product and the tax-related thereto will be refunded to you within fourteen (14) calendar days. The way your refund is processed depends on your original payment method, and a credit note will be issued in the original invoice. Please contact your bank or card issuer to confirm the actual time of receipt.
7.9 The refund amount will be based on the original ordered price; please refer to the estimated refund amount provided during the return process.
7.10 If We have not received the returned product within fourteen (14) calendar days of your request for a return, your return request will be automatically cancelled.
7.11 Products can be returned only in the country or region in which they were originally purchased.
7.12 We do not offer product exchanges except for the situation in clause 7.2. If you need a product with different specifications or if the product purchased is not as you expected, we recommend that you apply for a return within thirty (30) calendar days from the date of purchase and then purchase the product that you need.
7.13 Synology only accepts returns of products purchased from the Site. For returns of products purchased through other channels, please contact the original purchase channel.
7.14 The date calculations in this clause and in the clause entitled "6. Cancellation of Order by Customer" will expire at the end of the next working day if the end falls on a weekend or public holidays in Germany.
8. Customer Service
If you experience any problems with your order, or want to check the status of your order, please check your Synology Account or contact the our customer service.
9. Limited Warranty
9.1 Products directly purchased from the Site are eligible for the warranty service. For warranty periods, please refer to the Product Support Status.
9.2 The warranty period will commence on the invoice date. You may confirm your invoice date in your Synology Account. For warranty-related terms, please refer to the Limited Product Warranty.
10. Limitation of Liability
10.1 THE REMEDIES DESCRIBED IN OUR LIMITED PRODUCT WARRANTY UNDER SECTION 9 ARE YOUR SOLE REMEDIES AND OUR ENTIRE OBLIGATION AND LIABILITY FOR ANY BREACH OF THIS LIMITED PRODUCT WARRANTY . OUR LIABILITY WILL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE PRODUCT OR SERVICE THAT YOU HAVE PURCHASED THROUGH THE SITE, NOR WILL WE UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY LOSS OF PRODUCTION, WORK, DATA, USE, BUSINESS, GOODWILL, REPUTATION, REVENUE OR PROFIT, ANY DIMINUTION IN VALUE, COSTS OF REPLACEMENT PRODUCTS OR SERVICES, OR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT.
10.2 We are not liable for slight negligent breaches of obligations, provided that these breaches are not related to essential contractual obligations, damages for injury of life, limb or health, or warranties or claims under the Product Liability Act.
11. Recycle
11.1 We provide a recycling service for Synology-branded electronic devices which are sold from the Site.
11.2 To utilize the service, you can ship the compliant devices to the address indicated below at your own shipping costs, and mark the content and purpose clearly on the exterior of your shipping package.

11.3 If the recycling devices do not meet the terms, we reserve the right to reject the application for the service.
12. Export Restriction
Products purchased from the Site will only be shipped to addresses (excluding P.O. box addresses) within the European Union except for Malta, Switzerland, Monaco, Andorra, and Liechtenstein, and are subject to the German and foreign export control laws and regulations. Products must be purchased, sold, exported, re-exported, transferred, and used in compliance with all export laws and regulations.
13. Alternative Dispute Resolution
Alternative dispute resolution is an optional process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court. You can submit a complaint to EU Online Dispute Resolution platform through their website.
Synology is not obliged to participate in a dispute resolution procedure before a consumer arbitration board (ADR) or an EU online dispute resolution (ODR).
14. Applicable Law and Jurisdiction
Unless applicable mandatory regulations in your country or region, the place of performance for all services arising from the business relations with us as well as the place of jurisdiction shall be Our registered office, insofar as you are not a consumer but a merchant, a legal entity under public law, or a special fund under public law. The same shall apply if you do not have a general place of jurisdiction in Germany or the European Union, or if your place of residence or habitual abode is unknown at the time the action is brought. The right to also call upon the court at another legal place of jurisdiction remains unaffected by this.
